GENERAL CONDITIONS OF SUBSCRIPTION TO WASTE DISPOSAL.
Indications/Subscription
This subscription complies with the legislation in force on environmental management in the Democratic
Republic of Congo, in relation to Law No. 11/009 OF July 9, 2011 on fundamental principles relating to environmental protection.
The waste management service of the company Dunia Resources SA, having its head office at Avenue Kasaï No 100, Q/Makutano, Commune and City of Lubumbashi, hereinafter referred to as the “Service Provider”.
The Service Provider is authorized and qualified to provide waste collection and transportation services in accordance with current legislation. The customer will find all the membership conditions in full knowledge of the facts for the efficient and responsible management of their waste.
The service provider provides the waste management service in accordance with the terms and conditions set out.
The waste management service includes the collection, transportation, processing of waste produced by the Clients.
1. General conditions for B2C customers (residential or individual) and for B2B customers (business or commercial)
2.1 Customer Responsibilities
a. The Customer undertakes to sort and package the waste in accordance with the regulations in force and the directives or instructions of the Service Provider.
b. The Customer undertakes to provide the Service Provider with all necessary information on the types of waste to be collected and the actual quantity.
c. The residential Customer is required to place the waste to be collected in front of his plot from 7 a.m. to 11 a.m.
d. The commercial Customer is required to place waste in designated locations accessible by collection vehicles from 8 a.m. to 11:30 a.m.
e. The Customer undertakes to put the waste in garbage bags then place inside the bins or bags provided for this purpose and must ensure that the lid of the bin can close completely when it is full for collection.
f. The Customer undertakes to ensure that waste is kept according to environmental standards without contamination.
g. The Customer undertakes to inform the service provider of any modification to the waste collection schedule or the requirements in this area.
h. The Customer undertakes to inform the service provider of any hazardous or sensitive waste requiring special handling.
i. The Customer undertakes to comply with regulations relating to waste management and environmental laws.
j. The Customer undertakes to ensure that payment is made on time.
k. The Customer is responsible for the safety and integrity of the collection packaging and its contents.
2.2 Responsibilities of the waste management company
a. The Service Provider will collect waste in accordance with the service package collection subscribed by the Customer.
b. The Service Provider undertakes to provide the following waste management services, to conduct its
business in a professional manner and to comply with all applicable waste management laws and regulations.
c. The Service Provider will not be liable for damage resulting from negligence or non-compliance with the Client's obligations.
d. Regular waste collection in accordance with an agreed schedule.
e. Collection of recyclable waste (sort), separate and package by the customer in accordance with regulations in force and the directives of the Service Providerf. Transportation of waste to appropriate facilities.
g. Treatment and storage of waste in accordance with applicable laws and regulations.
h. Provide customer assistance and pre-consultation services to design and implement a personalized waste management plan at the request of these customers
i. The Service Provider is not responsible for damage caused by improperly packaged waste or waste that does not comply with current regulations.
j. The Service Provider will provide appropriate garbage bags for waste collection.
3 Description of waste management services
3.1 The service provider collects the waste under the following conditions :
a. Confidential shredding in accordance with current environmental standards and Customer directives
b. Household waste
c. Garden waste
d. Recyclable waste
3.2 The service provider does not collect the following waste :
a. Medical waste
3.3 The service provider collects special waste once examined and approved. special waste is among others:
a. Construction waste
b. Hazardous waste (glass, sharp objects, etc.)
3.4 Waste collection procedures and guidelines :
a. It is important to facilitate the service provider by following the guidelines to ensure a smooth waste collection process. Failure to follow these guidelines may result in missed collections or additional charges to the customer.
Directives
- Waste bags should not be overfilled and overflow
- Trash bins must be placed outside before 7 a.m. on collection day
- Recyclable items such as plastic, paper and glass should be separated from other waste
Procedures
- Waste must be placed at the designated collection point before the collection time.
- Waste bags must be securely tied and placed inside the trash can or designated collection point.
- Recyclable items should be placed in a separate container or bag to ensure proper collection.
3.5 Health and safety requirements
a. Proper storage: The service provider requires that all waste must be stored in safe, leak-proof and clearly labeled containers.
4 Payment and billing
a. The Customer undertakes to pay waste collection costs according to the agreed service package.
b. The Service Provider will issue regular invoices to the Client by email for the services rendered
c. Payment terms will be specified in the invoices issued by the Service Provider.
d. The Customer undertakes to pay the waste management service costs according to the terms agreedbetween the Parties. Fees will be invoiced monthly and payment must be made at beginning of every month within the first 5 working days of the invoice date.
e. The Client undertakes to authorize his bank and the service provider to automatically debit the fees agreed between the parties. In the event of late payment, penalty fees will be charged.
5 Duration of the service
This service comes into force on the date of membership and remains in force for a period of 12 months, unless it is terminated in accordance with the provisions of article 8 (Termination). 6 Confidentiality
Customers undertake to maintain the confidentiality of all confidential information disclosed in the context of the execution of this service.
7 Modification of delivery service
Any modification by the service provider must be in writing and brought to the attention of its customers..
8 Termination of service provision conditions
When the customer does not respect the general conditions of membership, this may be subject to termination of the service after written notification within one month's notice.
8.1 Dispute resolution
a. Communication: In the event of a dispute, the service provider settles the dispute amicably with its client, at the invitation of one of the parties.
b. Mediation: If the resolution of the dispute is not successful, the service provider and its client will settle the dispute by arbitration.
c. Arbitration: If the mediation does not succeed through arbitration, the service provider and his client will find the solution before the arbitration judge.
d. The arbitral tribunal: this is when the arbitral decision is contested by the service provider or by the client. the composition of the arbitral tribunal is made up of three judges, two of whom are chosen by the service provider and the client and the third is chosen by the two judges.
8.2 Termination and renewal conditions
The service provider may terminate the service conditions by giving 30 days' notice. All unpaid invoices must be settled and reconciled with the customer before termination of services. If the customer is not satisfied with our services, he can notify his termination of our services within 30 days. Our services will be automatically renewed for 12 months, if the customer has not notified the termination.
9 Intellectual property
Any intellectual property developed or used by the Service Provider as part of the provision of waste management services remains the exclusive property of the Service Provider..
10 Order and payment
The Client may place orders for waste management services via the Service Provider's website or by any other means of online communication made available by the Service Provider. The Customer undertakes to pay waste management costs according to the terms agreed between the Parties. Fees will be invoiced monthly and payment must be made at beginning of every month within the first 5 working days of the invoice date.
